AGREEMENT TERMS & CONDITIONS

Session Fees/Advance payment: An advance payment & signed contract are required to reserve your wedding date and is non-refundable. The non-refundable advance payment is a fee that retains the photographer’s services for your scheduled session date that the photographer has turned down other work for. The Agreed payment must be done before the wedding day, or else Bandhan Moments Photography will fail to provide the services. Payments can be split up leading up to the wedding in a payment plan that is agreed upon between the client and Bandhan Moments Photography. No photography will be fulfilled without an Agreed payment done before the wedding date stated in this contract.

Change of Date or Venue: Bandhan Moments Photography must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of the event. It is the client's responsibility to confirm all arrangements at least 7-10 days prior to the event. In cases, the change which is made by the client which is going beyond the Bandhan moment's pre-decided budget, the excess amount has to be borne by the client.

Exclusive Photographer: Bandhan Moments Photography shall be the exclusive photographer(s) retained by the client for the purpose of photographing the wedding. Family and friends of the clients and other wedding vendors (NA for single-side Booking) SHALL NOT interfere with the photographer's duties. Guests will be asked to refrain from taking photographs from certain positions and vacant certain positions at the time of the wedding at certain intervals of wedding services to ensure proper exposure and angle of images.

Copyright Information: The photographs produced by Bandhan Moments Photography are protected by Copyright Laws and MAY NOT be reproduced, cropped, or altered in any manner. The client hereby turns down any claims of ownership, income, editorial control, and the use of the images for commercial purposes. If displayed on social networking sites, any photo shared on the internet should be either captioned crediting Bandhan Moments Photography or tagging Bandhan Moments Photography in the actual photograph.

Cancellation or Postponement Policy: There shall be NO refund of the advance amount, after signing of the agreement, due to the reservation of the photography dates. If the event is canceled within 1 month of the wedding date, the client shall pay 50% of the balance of the contract due to the high probability, that Bandhan Moments Photography will not be able to further book that date. Once a balance is paid, it is NON-REFUNDABLE. Any other arrangements shall be discussed between the client and Bandhan Moments Photography. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Bandhan Moments Photography of the cancellation.

Creative License: Images are edited at the photographer's (Bandhan Moments Photography) discretion, and delivered images may not include all images shot. The photographers (Bandhan Moments Photography) reserve the creative right to edit and release only those deemed creditable as professional quality and within the photographer's artistic standards. All images released are high-resolution JPEG. RAW files are not released.

Flash Drive Storage: Due to the lack of information about how long flash drives can hold information, After delivery of the final version Bandhan Moments Photography recommends clients back up images on another media format other than flash drives, such as an external hard drive. Bandhan Moments Photography also recommends making multiple copies of the images from the flash drive to ensure the images are kept for years to come. Bandhan Moments Photography cannot be held responsible for the failure of the flash drives due to mishandling. It is the client's responsibility to keep several copies of any flash drive in more than one location and back the images up in another format such as a hard drive.
For the Clients who have been asked to provide an external hard drive, Bandhan Moments takes full responsibility of the data, in case of any failure the client is entitled to get full refund of the payment.

Archival of Images: After you receive your final delivery, Bandhan Moments Photography archives the photos for a total of TWO months.

Failure to Perform: Due to the limited and subjective nature of the event, Bandhan Moments Photography cannot be held responsible for photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by anyone in or at the event. The photographer is not responsible for the lost photo opportunities due to other cameras or flashes, Mobile photographers the lateness of the bride or groom, other principles, rules, and restrictions of the venue, or the situation of decorations of the location. It is acknowledged that any photo wish lists submitted to Bandhan Moments Photography will be used for organizational purposes and in no way represent photography that will be produced. Bandhan Moments Photography will do its best to fulfill all requests but can make no guarantees all type of requested images will be delivered. Clients will bear all location fees and permits.

Bride groom Portraits: Clients will be guided through the whole process and they need to understand to make their memory beautiful Bandhan Moments need some time to get their best shots at various places during the event. Hence the cleits are requested to allow sufficient space and time to get the best shots as much as possible. This will be communicated at various times during the event to the clients if we are not satisfied with the shots.

Lighting and location Advice - Lighting and location advice will be given to the clients, The client needs to understand that any hard or wrongly placed light can ruin a good wedding decoration and photographs. hence it is advised to follow the instructions from the Bnadhan Moments photography team. Bandhan moments Photography cannot be held responsible for choosing a too-compact location or unwanted high-temperature of lights for any rituals (suggestions will be provided).

Transport : The transport costs has to be bourne by the clients. That needs to be cleared on the last date of the event.

Payment : Payment schedule must also have been shared with the clients, They need to follow the same to get the deliverables on time.

• Advance - Has be paid for the booking. (Non-refundable on Cancellation, Adjustable on re-schedule)

• Major payment on or before the event day - This amount has be paid on the 1st day of the event.

• The following payment - Needs to be paid on album selection time. (Only then Video Processing will start)

• Additional Payment - Needs to be paid in case of more number of changes on the delivered contents or enhancement in the number of pages or quality in the album.

Unforeseeable circumstances: If Bandhan Moments Photography or its members cannot perform this agreement due to a fire, casualty, strike or other civil disturbances or fire, terrorism, but not to road closures, severe traffic jam, event of god or other causes which is beyond the control either of the parties, then no refund of any previous paid amount will be given to the customer. in case any content is lost due to any mistake from Bandhan Moments side or photographic materials are damaged in processing, lost through camera malfunction, compact flash card malfunction, or lost in the mail, or otherwise lost or damaged before delivery of the final content Bandhan Moments photography is responsible to give a compensation to the customer based on the criticallity of the lost content. In case any data loss or intentional damage is caused by the customer on the data or the equipment, without the fault on the part of Bandhan Moments Photography, the client is liable to pay the amount of the equipment and the additional costs if any.

Damage Measure: The client needs to make sure of the local security of the photographers and their equipment. Since all the photographers will be using very high-value equipment any damage to the photographer or videographer or any of the equipment is caused intentionally by any of the guests or clients, then needs to be paid back on the spot with the claimed amount by the member.

Team of Photographers: Bandhan Moments Photography will hire a team of photographers, if applicable to the client's chosen package.

Event Food Service: A meal is required for the persons from the Bandhan Moments Photography team for events of more than 3 hours or longer. In case the client is not in a position to provide the food to the team, the billed amount for food has to be borne by the client, which will be calculated over the total project cost.

Delivery of Products: The client will receive their raw low-resolution JPEG images, via an online gallery within a week following the last wedding date. and the client's selection must be given back within two calendar months from the date when the photo gallery was shared. in case of delay, it may increase the print cost in case of print price enhancement. if the client's selection is delayed more than two months from the image gallery was shared with the client, Bandhan Moments will not be responsible for any data loss or damage to the content. and no money refund process can be claimed. all the processes for video edit also will start once the photo selection is given back from the client side.

The client will receive their final high-resolution, hand-edited JPEG images, album design, and wedding video via an online gallery within sixteen to twenty weeks following the final selection date. This includes only two requests by the client for further edits or enhancements.

Entire Agreement: This agreement contains the entire understanding between Bandhan Moments Photography and the Client. It supersedes all prior agreements between parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.

The undersigned have read and understood the contract and agree to the terms and conditions in their entirety. Only the bride and groom (or signers of this document) can discuss any problems that arise.

We kindly ask you to get in touch with us two weeks before the date of your event to touch base and go over last-minute details. We will make every effort to contact you, but it is the client's responsibility to contact Bandhan Moments Photography to confirm wedding details and times. Hi-resolution images on a flash or hard drive. The client understands the images given on flash drives cannot be used for profit or advertising.
