AGREEMENT TERMS & CONDITIONS

BANDHAN MOMENTS PHOTOGRAPHY

WEDDING PHOTOGRAPHY & CINEMATOGRAPHY

TERMS & CONDITIONS

This Agreement is made between Bandhan Moments Photography (“the Photographer/Studio”) and the Client(s) for photography, cinematography, editing, album design, printing and other services agreed upon in the selected package.

By signing this Agreement and making the booking payment, the Client confirms that they have read, understood and agreed to the following Terms & Conditions.

1. BOOKING & ADVANCE PAYMENT

1.1. The booking will be confirmed only after:

• Payment of the agreed booking advance; and

• Acceptance/signing of this Agreement.

1.2. The booking advance is non-refundable as it reserves the selected date exclusively for the Client and prevents the Photographer from accepting other assignments on that date.

1.3. The advance payment will be adjustable against a mutually agreed rescheduled date, subject to the Photographer's availability and applicable rescheduling conditions.

1.4. The Photographer shall not be obligated to provide services if the agreed payment due before the wedding/event has not been received.

2. PAYMENT SCHEDULE

Unless otherwise agreed in writing, the payment schedule shall be:

• Booking Advance: Payable at the time of booking.

• Major Payment: Payable on or before the first day of the event.

• Album/Video Processing Payment: Payable at the time of photo selection/album selection, as applicable.

• Additional Charges: Payable for additional pages, additional prints, extra editing requests, additional deliverables, upgraded products, additional coverage or any other service not included in the original package.

The agreed payment schedule must be followed to ensure timely processing and delivery of the final products.

3. CHANGE OF DATE, VENUE OR EVENT SCHEDULE

3.1. Any change in the wedding/event date, venue, timing or schedule must be communicated to Bandhan Moments Photography as early as possible and preferably at least 7–10 days before the event.

3.2. Rescheduling is subject to the Photographer's availability.

3.3. If the new date is unavailable, the Photographer shall not be obligated to provide the same services on another date.

3.4. Any additional transportation, accommodation, equipment, manpower, location charges or other expenses arising because of a change requested by the Client shall be borne by the Client.

3.5. The Client is responsible for confirming the final event schedule, venue and timings with the Photographer before the event.

4. COVERAGE & EXCLUSIVE PHOTOGRAPHY

4.1. Bandhan Moments Photography shall be the designated professional photography/cinematography team for the services included in the selected package.

4.2. Guests, family members, other photographers, videographers or vendors should not obstruct or interfere with the Photographer's working position, lighting, equipment or creative process.

4.3. The Photographer may request guests to move from certain positions during important rituals, portraits or group photographs to ensure proper composition, lighting and unobstructed coverage.

4.4. The Photographer cannot guarantee any particular photograph if the opportunity is obstructed or affected by guests, other photographers, mobile phones, flashes, lighting or venue restrictions.

5. EVENT SCHEDULE & CLIENT COOPERATION

5.1. The quality and quantity of coverage depends substantially on the Client following the agreed schedule.

5.2. Delays caused by the Client, family members, guests, makeup, transportation, rituals, venue arrangements or other vendors may reduce the available photography time.

5.3. The Photographer shall not be responsible for missed photographs or reduced coverage resulting from delays or schedule changes beyond the Photographer's control.

5.4. For bride/groom portraits and couple sessions, the Client agrees to provide reasonable time and cooperation so the Photographer can create the best possible photographs.

6. RITUALS, TRADITIONS & SHOT REQUESTS

6.1. The Photographer will make reasonable efforts to cover the important rituals and events communicated in advance.

6.2. Any specific shot list or requested photographs will be treated as a request and planning reference only, and shall not constitute a guarantee that every requested photograph will be captured.

6.3. The Photographer shall have creative discretion regarding composition, lighting, angles, poses and selection of photographs.

6.4. The Photographer shall not be responsible for photographs that could not be captured due to circumstances including, but not limited to, crowd movement, poor lighting, venue restrictions, limited time, obstruction, rituals taking place unexpectedly, or other unavoidable circumstances.

7. LIGHTING & LOCATION

7.1. The Photographer may provide recommendations regarding lighting, stage positioning, decoration, portrait locations and available space to improve the quality of photographs and videos.

7.2. The Client understands that excessively bright, improperly positioned or unsuitable lighting can negatively affect photographs and videos.

7.3. The Photographer shall not be responsible for reduced image/video quality caused by lighting, decoration, location restrictions or conditions that are outside the Photographer's control.

8. CREATIVE CONTROL & IMAGE SELECTION

8.1. Photography and cinematography involve artistic and creative judgment. The Photographer retains creative discretion over the selection, colour grading, editing, cropping and overall visual treatment of the delivered photographs and videos.

8.2. Not every photograph captured during the event will be delivered.

8.3. Duplicate, technically defective, blurred, closed-eye, accidental, test, unusable or otherwise unsuitable photographs may be excluded from the final delivery.

8.4. The final delivered photographs will consist of the images selected by the Photographer as suitable for professional delivery.

8.5. Unless specifically included in the package, RAW/unedited camera files shall not be provided.

9. RAW FILE DELIVERY & CLIENT RESPONSIBILITY

9.1. Where RAW/low-resolution selection files are included in the agreed package, they shall be delivered through an online gallery or other agreed method.

9.2. The Client is responsible for downloading and securely storing the files after delivery.

9.3. Bandhan Moments Photography strongly recommends maintaining multiple backups on independent storage devices/cloud storage.

9.4. Once the files have been successfully delivered to the Client, the Photographer shall not be responsible for loss of files caused by the Client's failure to download, copy or securely store them.

10. FILE ARCHIVAL & BACKUP POLICY

10.1. Bandhan Moments Photography shall maintain an archive/working backup of the delivered content for up to 6 months from the date of RAW/initial file delivery, unless otherwise agreed in writing.

10.2. No guarantee of file backup or availability shall be provided after the completion of this 6-month period.

10.3. After 6 months, files may be permanently deleted from the Photographer's storage without further notice.

10.4. The Client is therefore solely responsible for maintaining independent backups of all delivered files.

10.5. The Photographer shall not be obligated to recover, restore or re-deliver files after the applicable archival period.

11. PHOTO SELECTION DEADLINE

11.1. The Client shall provide the required photo selection for album design, prints and other selection-based deliverables within 2 calendar months from the date on which the selection gallery/files are provided.

11.2. The Client is responsible for ensuring that the required selections are submitted completely and correctly.

11.3. Delayed selection may result in a corresponding delay in album, video or print delivery.

11.4. Any increase in printing, album manufacturing, material or production costs caused by delayed selection shall be borne by the Client.

12. LONG-DELAY / UNCLAIMED SELECTIONS

12.1. If the Client does not provide the required photographs/files/selections for album design, printing or other pending deliverables within 6 months from the date of final RAW/initial file delivery, Bandhan Moments Photography may consider the pending deliverable as on hold due to Client delay.

12.2. If the Client subsequently requests the Photographer to retrieve files, reopen the project, perform selection-related work, create album designs, arrange prints or resume processing after the 6-month period, an additional processing/retrieval/service fee may apply.

12.3. Any applicable additional fee shall be communicated to the Client before the work is resumed.

12.4. The Photographer shall not be responsible for maintaining the project files or backup indefinitely after the 6-month period.

13. ALBUM DESIGN & EDITING REVISIONS

13.1. Album design will be prepared based on the photographs selected by the Client.

13.2. The Client shall receive a maximum of 2 rounds/sets of edit or revision requests for the album design.

13.3. Each round may contain multiple corrections or edit requests submitted together.

13.4. The Client is requested to consolidate all required corrections and provide them together in each revision round.

13.5. Additional revision rounds beyond the two included rounds may be charged separately depending on the extent of work required.

13.6. Changes requested after final approval of the album design may also attract additional charges.

13.7. Additional album pages, upgraded paper/material, cover changes, extra prints or other modifications not included in the original package shall be chargeable separately.

14. VIDEO EDITING & SONG SELECTION

14.1. For cinematic/highlight/wedding films where the Client has the option to select songs, the song selection must be provided before the editing process begins.

14.2. Wherever applicable, the Client should also specify the ritual/event/section for which each selected song is intended.

14.3. If the Client does not provide the song selection within the required time, Bandhan Moments Photography shall select suitable music based on its creative judgment and make the best possible effort to create a visually and emotionally appropriate film.

14.4. Once the video editing has commenced, the Client shall be allowed a maximum of 2 song-change requests.

14.5. Any additional song changes beyond the included limit may attract additional editing charges and may also extend the delivery timeline.

14.6. Song selection must comply with applicable copyright/licensing requirements. The Photographer shall not be responsible for copyright claims arising from music supplied or specifically requested by the Client.

15. FINAL DELIVERY TIMELINE

15.1. Subject to timely payment, photo selection, song selection, approvals and Client cooperation, the final high-resolution edited photographs, album design and wedding video shall generally be delivered within 16–20 weeks from the date of receiving the final required selections/inputs from the Client.

15.2. The delivery timeline may be extended in cases of:

• Delayed photo selection;

• Delayed song selection;

• Delayed approvals;

• Additional revision requests;

• Additional products or pages;

• Printing/manufacturing delays;

• Force majeure or circumstances beyond the Photographer's reasonable control.

15.3. The Photographer shall make reasonable efforts to complete the work within the communicated timeline but the timeline shall not be treated as a guarantee where Client inputs or external circumstances cause delays.

16. PRINTING & ALBUM PRODUCTION

16.1. Album printing and production will commence only after the Client provides final approval of the album design and all applicable payments have been cleared.

16.2. Once the album has been approved for printing, changes may not be possible without additional charges.

16.3. Minor variations in colour, printing, paper texture or material may occur due to differences between digital displays and physical printing processes.

16.4. Additional copies, duplicate albums, extra pages, upgraded materials or reprints shall be charged separately.

17. DELIVERY MEDIA & STORAGE DEVICES

17.1. Where photographs are delivered through a flash drive, hard drive or other physical storage medium, the Client is advised to immediately create additional backups.

17.2. Storage devices can fail, become corrupted or be damaged through improper handling.

17.3. The Photographer shall not be responsible for data loss resulting from the Client's mishandling, damage, corruption or failure to maintain independent backups after delivery.

17.4. Where the Client specifically provides an external hard drive to the Photographer for data transfer, the Photographer shall take reasonable care of the device while it is in its possession. However, the Client should retain a separate backup of any important data stored on the device.

18. FAILURE TO PERFORM / MISSED COVERAGE

18.1. The Photographer cannot be held responsible for photographs or video footage that could not be captured because of:

• Weather conditions;

• Traffic or transportation delays;

• Venue restrictions;

• Poor or insufficient lighting;

• Guest interference;

• Other photographers or videographers;

• Mobile phones or flashes obstructing the view;

• Delayed arrival of the bride, groom or family members;

• Changes in the event schedule;

• Restrictions imposed by religious authorities or venue management;

• Sudden or unexpected rituals/events;

• Other circumstances beyond the Photographer's reasonable control.

18.2. The Photographer will make reasonable efforts to capture the important moments but cannot guarantee the capture of every individual, ritual, pose or requested photograph.

19. UNFORESEEABLE CIRCUMSTANCES / FORCE MAJEURE

19.1. If the Photographer or any member of the team is unable to perform the Agreement due to circumstances beyond reasonable control, including natural disasters, fire, serious accident, civil disturbance, strike, government restrictions, terrorism, major technical failure or other force majeure circumstances, the Photographer shall not be considered in breach of this Agreement.

19.2. In such circumstances, the parties shall make reasonable efforts to find an alternative solution, replacement professional or mutually acceptable arrangement where practically possible.

19.3. Any refund or compensation in such circumstances shall be determined based on the actual services performed, expenses incurred and circumstances of the event, subject to applicable law.

20. DATA LOSS / TECHNICAL FAILURE

20.1. Bandhan Moments Photography maintains reasonable professional practices for protecting client data.

20.2. In the unlikely event of data loss caused by equipment malfunction, memory card failure, accidental damage or other technical failure before final delivery, the Photographer shall make reasonable efforts to recover the data.

20.3. If the content cannot be recovered, any compensation or remedy shall be determined based on the extent and importance of the lost content and the circumstances involved, subject to applicable law.

20.4. The Photographer shall not be liable for circumstances caused by the Client, guests or third parties.

21. DAMAGE TO EQUIPMENT / PERSONAL SAFETY

21.1. The Client shall take reasonable steps to ensure the safety of the Photographer, cinematographers and their equipment at the venue.

21.2. If any equipment belonging to Bandhan Moments Photography is intentionally or negligently damaged by the Client, guest or any person associated with the Client, the Client may be responsible for the reasonable repair or replacement cost, subject to applicable law.

21.3. The Photographer reserves the right to stop work if the team or equipment is placed in a situation involving a serious and immediate safety risk.

22. TRANSPORTATION, ACCOMMODATION & LOCATION EXPENSES

22.1. Transportation expenses for the photography/cinematography team shall be borne by the Client unless specifically included in the package.

22.2. Parking, tolls, permits, entry fees, location fees and other necessary charges shall be borne by the Client where applicable.

22.3. For events requiring travel outside the agreed location or overnight stay, accommodation and related expenses shall be borne by the Client unless otherwise agreed in writing.

23. FOOD & BASIC REQUIREMENTS FOR TEAM

23.1. For events exceeding 3 hours or where the photography/cinematography team is required for an extended period, reasonable meals and drinking water shall be provided to the team.

23.2. If food is not provided by the Client, the reasonable cost of meals for the team may be added to the project charges.

24. COPYRIGHT & USAGE RIGHTS

24.1. All photographs, videos and creative works produced by Bandhan Moments Photography remain protected by applicable copyright laws.

24.2. The Client receives a personal, non-exclusive right to use the delivered photographs and videos for personal purposes.

24.3. The Client shall not commercially sell, license, reproduce or substantially modify the photographs/videos without written permission from Bandhan Moments Photography, except where otherwise agreed in writing.

24.4. The Client may share photographs on social media for personal use. Where reasonably possible, credit/tagging of Bandhan Moments Photography is appreciated.

25. PORTFOLIO & PROMOTIONAL USE

25.1. Unless the Client specifically requests otherwise in writing before the event, Bandhan Moments Photography may use selected photographs and video clips from the wedding for:

• Portfolio;

• Website;

• Social media;

• Advertising;

• Promotional materials;

• Awards and professional competitions.

25.2. If the Client requires complete privacy and does not want any photographs/videos used publicly, this requirement must be communicated and agreed upon in writing before the event.

26. CLIENT APPROVALS

26.1. The Client is responsible for carefully reviewing selections, album designs, spelling, names, dates and other details before giving final approval.

26.2. Once final approval is provided and production begins, Bandhan Moments Photography shall not be responsible for errors that were visible during the approval stage.

26.3. Any correction required after final approval may incur additional charges.

27. COMMUNICATION & AUTHORISED REPRESENTATIVE

27.1. Only the Client(s) or the person(s) authorised by the Client shall communicate official instructions regarding selections, album design, video editing and other deliverables.

27.2. Instructions from multiple family members or third parties may create conflicting requirements. Therefore, Bandhan Moments Photography shall be entitled to follow instructions only from the designated Client representative(s).

28. CANCELLATION

28.1. Cancellation must be communicated in writing.

28.2. The booking advance shall remain non-refundable because the date has been reserved exclusively for the Client.

28.3. If the event is cancelled within 30 days of the scheduled event, the Client may be liable to pay up to 50% of the remaining contract value, considering the likelihood of the Photographer being unable to re-book the reserved date.

28.4. Any payment already made towards completed or commenced services, products, printing, editing or production may be non-refundable.

28.5. Any exception or alternative arrangement must be mutually agreed upon in writing.

29. ADDITIONAL WORK & SERVICES

Any service or work outside the original package may be charged separately, including but not limited to:

• Additional event hours;

• Additional photographers/cinematographers;

• Additional albums;

• Additional album pages;

• Additional prints;

• Additional editing/revision rounds;

• Additional song changes;

• Reopening an archived project;

• File retrieval after the applicable deadline;

• Additional travel;

• Additional location/venue requirements;

• Re-editing previously approved content;

• Upgrades to album materials or printing quality.

No additional work shall be considered included unless specifically agreed upon.

30. CLIENT RESPONSIBILITY FOR VENUE & PERMISSIONS

The Client shall be responsible for obtaining necessary permissions from venues, temples, marriage halls, authorities or other locations where photography/cinematography restrictions may apply.

The Photographer shall not be responsible for reduced coverage caused by restrictions imposed by such authorities or venues.

31. DELIVERY OF FINAL PRODUCTS

The final deliverables shall be limited to the items specifically mentioned in the selected package or quotation.

Any item not mentioned in the package shall not be considered included.

Physical products shall be delivered or made available according to the mutually agreed delivery method.

32. ENTIRE AGREEMENT

This Agreement, together with the selected package/quotation and any written amendments signed or accepted by both parties, constitutes the complete understanding between Bandhan Moments Photography and the Client.

Any verbal discussion or promise that is not included in the Agreement or confirmed in writing shall not be considered part of the agreed deliverables.

Any amendment to this Agreement must be made in writing and accepted by both parties.

33. ACCEPTANCE

By signing this Agreement and/or making the booking payment, the Client confirms that:

• They have read and understood these Terms & Conditions.

• They have had the opportunity to ask questions regarding the services.

• They agree to the payment and delivery terms.

• They understand the photo selection, editing, album and video revision limits.

• They understand the 6-month archival/backup policy.

• They understand that delayed Client inputs may delay final delivery and may result in additional charges.

• They agree to the creative discretion of Bandhan Moments Photography.
